Guarantees
All shared hosting and reseller accounts have a full money back guarantee, if cancelled within 16 days after payment. If your account is 16 days or older, no refunds will be given. Your account can be cancelled anytime. No partial refunds will be given for
unused days/months. While this isn't our normal procedure, we have to right to cancel your account
immediately, even if there are still days left in your account, when cancelled.
If your account has less than 99.5% uptime we will give you a partial refund
for the total time that your site is down. Example: If you account has been down for 0.9% we will credit 0.9% of your monthly fee. If the total monthly uptime has been lower than 80% we will refund the full month. Server and network maintainance are an exception: they do not count for the uptime guarantee.
Unsolicited E-mail/Spam
We have to right to suspend your account when we get notices that your account(s) are sending
out spam. This is either by mail, web or usenet. If it's true - we will deactive the account, no refunds will
be issued. There will be a $100 administrative fee for every true complaint.
Unsolicited is defined, by HTBD as: E-mail sent to recipients who have not
asked to be contacted by you or Usenet postings (that are cross-posted to
more than three newsgroups and/or posted in newsgroups where this is against
that groups FAQ or charter), for the sole purpose of promoting a website or
commercial business on our servers.
Excessive Bandwidth Use
If your hosting account, goes over the bandwidth allowance set for that account, you agree
to pay for that overage. Currently, the rate charged by HTBD for
bandwidth is $15 per 1 GB. If your account goes over its bandwidth allowance
for the month, you must either upgrade your account or purchase additional
bandwidth to cover your account bandwidth usage. All bandwidth/traffic/diskspace
amounts are measured in Megabytes/Gigabytes. We have to right to (temporarily) suspend a site if it is using a very high amount of bandwidth. The suspension of your website will not count in the uptime guarantee.
Account Termination
Violation of our anti-spam policy will be grounds for immediate account termination.
Web sites deemed offensive, pornographic or racially degrading, by HTBD, will be removed from our servers without notice. Web sites promoting,
making available or otherwise contributing to software piracy, hacking, spamming,
denial of service attacks and/or damage to commercial networks or servers
will be removed from our servers without notice and illegal acts will be reported
and prosecuted. Abusive behavior of any type will not be tolerated. Free For
All (FFA) link sites and using your account for IRC/BBN purposes is not allowed
on our servers.
Accounts using up enough server resources, to slow or crash a server, will
be shut down. Popular BBS, webcams, forums and message board programs are
generally not allowed, due to the massive amount of server resources they
require. FormMail.pl, FormMail.cgi (we have a formmail script
available) phpBB ( you can use phpBB2 ), phpNUKE, Yabb and UBB are
strictly prohibited on all user accounts. (postNUKE is allowed). If you are unsure if a script is allowed, please contact us and we will take a look at it.
Third-party installed versions of FormMail are forbidden, due to the security risk they pose. We have FormMail available, globally, for all accounts on our network.
All server activity is logged. Any snooping, hacking, or other inappropriate activity of any type outside of your account, on our servers, will be grounds for termination.
In addition, your account is for web and email use only, any other activities, at our sole discretion, will be grounds for termination as well.
This Terms of Service may be amended, at any time, at the discretion of HTBD. All accounts are required to comply with any changes made to these policies. Notification of any major changes to the policies will be emailed to all account holders.
If you are unsure if what you are doing is against our terms of service, contact us. There are no refunds granted for accounts terminated due to terms of service violation.
